Joseph L. Bocchini Letter Clearing Hsueh, Geevers, and Herbert

Dear Councilman Morgan:

The Mercer County Prosecutor’s Office has recently completed its

investigation into your allegations concerning Mayor Shing-Fu Hsueh,

Councilwoman Linda Geevers, and Michael Herbert, Esquire. Our

investigation consisted of document review, review of the transcripts

of West Windsor Township Council budget workshop meetings, interviews,

and a review of various e-mails, newspaper articles, and other

sources. The investigation consumed hundreds of hours.

In your letters to this office, dated May 4, 2009, May 14, 2009, May

18, 2009, July 15, 2009, and August 6, 2009, you allege that Mayor

Hsueh and Councilwoman Geevers conspired to commit and/or committed

numerous violations of the New Jersey Criminal Code. We have reviewed

each of your allegations and find that they have no basis in fact or

under the law. To the contrary, our review has revealed that the mayor

and Councilwoman Geevers played no role in the preparation of the

analysis of your proposal to utilize the fund balance to reduce the

municipal tax rate. Your allegations stretch the criminal code to

lengths not contemplated by the legislature. Accordingly, we do not

find any criminal conduct on the part of the mayor or Councilwoman

Geevers.

We would also take a moment to comment on the allegations you made

against Mr. Herbert. Initially, we would not that your allegations

relate to an issue that you clearly raised with Mr. Herbert at some

point during April of 2009. Based on our review of the documents and

interviews with involved parties, we are satisfied that Mr. Herbert

conducted the conference call with Mayor Hsueh and Russell Schenkman

in order to obtain information concerning the West Windsor Community

Foundation in order to respond to your questions about the Foundation

and to address your call for an investigation into the Foundation.

Accordingly, we do not find any wrongdoing on the part of Mayor Hsueh,

Councilwoman Geevers, and/or Mr. Herbert. We are, therefore, closing

our investigation in this matter.
