InterCap Objects To COAH Plans

InterCap Holdings has targeted West Windsor with legal action yet again — this time by filing an objection under the jurisdiction of the state Council on Affordable Housing.

In the lawsuit, InterCap is objecting to the township’s housing element and fair share plan, which it submitted in December to comply with the new COAH regulations. At the heart of the objection, is the contention “that West Windsor has understated its affordable housing obligations and that additional affordable housing should be provided for within the plan and West Windsor,” said InterCap spokesman Jonathan Jaffe. “We believe that the InterCap site is ideally suited for such additional, affordable development.”

InterCap attorneys forwarded a letter from David N. Kinsey — a planner with the firm Kinsey & Hand — addressed to Lucy I. Vandenberg, the executive director of COAH. InterCap says it is seeking “inclusionary rezoning of this parcel to allow mixed-use, transit-oriented, inclusionary development, including a substantial amount of housing affordable to low and moderate-income households.”

Under COAH’s third round regulations, West Windsor’s obligation through 2018 will require it to provide a total of 1,”783 affordable units — consisting of 899 units from prior round obligations, 861 new units from the projected growth share obligation, and 23 rehabilitation units.
